The following Terms of Use are entered into by and between You and Broadkill Writers Resort (“Company”, “we”, or “us”).
This Refund Policy governs your access to and use of BroadkillResort.com, including any content, functionality and services offered on or through BroadkillResort.com (the “Website”), whether as a guest or a registered user.
Please read the Refund Policy carefully before you purchase content, functionality and services offered on or through the Website. By using purchases made on or through the Website or by clicking to accept or agree to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by the Refund Policy.
For the sale of certain products, the Company provides a money-back guarantee. That money-back guarantee is governed by the following terms, except to the extent that the terms of a specific product or service provide otherwise.
Online Education
Products referred to on the Website as courses, leveling up experiences, classes, and group coaching, constitute "online education." For online education there is a thirty-day no questions asked refund available. The refund request must be made by email by the end of the 30th day from purchase, to concierge@broadkillresort.com. That email must contain information about the product you purchased, the date of the purchase, and the email and name associated with any such purchase. You are not required to submit any proof that you have completed any work or meet any other requirements.
Upon determining that you are entitled to a refund pursuant to this policy, the Company will promptly issue an instruction to its payment processor to issue the refund. The Company does not control its payment processor and will not be able to expedite any refunds.
If you receive a refund of any purchase through this money-back guarantee, that shall immediately terminate any and all licenses granted you to use the material provided to you under these Terms of Use or any other agreement. You shall immediately cease using the material and shall destroy all copies of the information provided to you, including without limitation: video recordings, audio recordings, forms, template documents, slide shows, membership areas, social media groups limited to paying members, and other resources.
Workshops
In-person ticketed events held at the Broadkill Writers Resort located at 907 N Bay Shore Drive, Milton, DE 19968, USA or operated by the Company at other locations, regardless of the duration of time for the event, constitute "workshops."
You may request to cancel your workshop ticket for a full refund, up to 72 hours before the date and time of the event by emailing concierge@broadkillresort.com. Cancellations between 25-72 hours before the event may transferred to a different date/time of the same workshop. Cancellation requests made within 24 hours of the class date/time may not receive a refund nor a transfer. When you register for a workshop you agree to these terms.
Rentals
Cancellations for rentals of the Broadkill Writers Resort facility must be received in writing at concierge@broadkillresort.com. Rental payments are fully refundable (less the amount of the Company’s reservation fee, which is earned on receipt and becomes nonrefundable 24 hours after booking) for cancellations received 30 or more days before the first night of your reservation.
No full or partial refunds will be granted for no-shows or if you cancel less than 30 days before the first night of your reservation, arrive after the first night of your reservation, or depart before the last night of your reservation. If you have cancellation insurance, call the insurance company directly to make your claim to determine if you have a “covered” cancellation. Only contracts paid in full obtain a full refund for a covered expense. If you do not have insurance, we will try to re-rent the property. If we are able to do so, you will receive your deposit back, less a 15% cancellation fee based on your gross rental. If we are unable to re-rent the property, the full balance for the rental is due from you.
Except as expressly provided in the signed Rental Agreement, no refunds or compensation will be given and the Company shall not be liable to you for failure to make the property available for occupancy if the property is unavailable or becomes partially or wholly unusable for any reason outside the Company’s control, including but not limited to adverse weather conditions, natural disasters, mechanical failures, evacuation orders or other acts of government agencies, or utility outages.
The Company advises guests to obtain appropriate and comprehensive travel insurance that covers Renter and all Occupants and that includes coverage for personal injury and property damage or loss. Any travel insurance you obtain shall be primary for all occurrences in which you or any Occupant claims injury, loss or damage.
Any Cleaning Fees or Pet Fees collected at the time of reservation will be fully refunded for all advance cancellations, but no full or partial refunds of such fees will be granted in the case of a partial stay, either due to arriving after the first night of your reservation or departing before the last night of your reservation.
Refund Disqualification
Accounts terminated, tickets revoked, or rentals canceled by the Company for violating Terms of Use do not qualify for a refund. Examples of such violations include but are not limited to unauthorized selling or redistribution of materials provided by the Company, breaking the terms of our Workshop Code of Conduct, or exceeding the Rental Agreement maximum occupancy. The Company will, at its discretion, issue warnings or make other attempts to remedy the situation if possible prior to account termination, ticket revocation, or rental cancellation.
Policy Changes
It is our policy to post any changes we make to our Refund Policy on this page. If we make material changes to how we treat our users' personal information, we will notify you by email to the email address specified in your account and/or through a notice on the Website home page. The date the privacy policy was last revised is identified at the bottom of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Website and this privacy policy to check for any changes.
